Federal Law requires due process for any action having an adverse affect on a person. The BOT Board of Tests regulates the processes and they must be approved through the APA American Procedures Act. Not only has the BOT circumvented the APA process for the intoxilizer 8000 but has allowed law enforcement employees to conduct unlawful SFST Standard Field Sobriety Tests. When an officer suspects a driver may be impaired the officer‘s immediately lose when the officer asks a question like “ when is the last time you’ve been drinking” or “ have you used any drugs or are you on any drugs” According the Medical Science there are approximately 36 different over the counter medications that will make a person seem impaired. ( This is one clue that reveals the officer has not received proper training). This is also a discriminatory statement and is punishable by law. The correct statement a trained officer will make is , “ excuse me, but do you take any prescription drugs ?” And a trained officer may only make that statement if there’s is Probable Cause. That means the officer cannot pull a person over for speeding and just ask that question as a routine process. That type of conduct becomes Harassment and is also punishable by law. The purpose of this study is to reveal the fact that law enforcement officers are not authorized to take a persons license for any reason because they are not judge and jury.
